Common Law Marriage in Pennsylvania
A "common law marriage" is one in which the parties may hold themselves out as a husband and wife, and under certain circumstances, be deemed married without a marriage license or ceremony. Pennsylvania was one of the very few states that recognized a common law marriage.
Common Law Marriage in Pennsylvania is no longer valid prospective to court decision on September 17, 2003 (PNC Bank v. Workers' Compensation Appeal Board). In 2005 the Pennsylvania legislature officially abolished common law marriage. They clarified that common law marriages formed before 2005 were still valid but that no relationships could be considered common law marriage after that.
